Colorado made history in 2022 by passing the Protections for Donor-Conceived Persons and Families Act, becoming the first state in the nation to establish comprehensive regulations for the egg and sperm donation industry. The legislation, which took full effect in July 2025, requires gamete agencies, gamete banks, and fertility clinics to obtain state licensing before matching or providing gametes to Colorado recipients. 

According to the Colorado Department of Public Health and Environment, these regulations were designed to protect donor-conceived individuals and their families by mandating transparency, ethical practices, and proper record-keeping throughout the donation process. The law addresses several critical areas of egg donation. All agencies must ensure identity disclosure, meaning donor-conceived individuals can access their donor’s identifying information when they turn 18. 

Agencies must maintain comprehensive medical and genetic records, request periodic updates from donors about their health status and contact information, and limit donor usage to no more than 25 families worldwide. Additionally, agencies must provide extensive educational materials to both donors and intended parents covering topics such as genetic screening, emotional considerations, and the importance of early disclosure to donor-conceived children.
